Cernavoda nuclear plant tender cancelled due to irregularities.
October 15, 2009
The National Council for the Settlement of Contestations in the Cernavoda new nuclear power plant public tender has overturned the decision of EnergoNuclear – the project company charged with overseeing the construction of nuclear reactors 3 and 4 at Cernavoda – in regards to the appointment of project legal counsel following a public tender that occurred over late summer 2009.
EnergoNuclear’s decision in favour of American law firm White & Case, was contested by a number of firms. In its decision, the National Council accepted the arguments of all of the law firms including that of POP PEPA; and citing irregularities, overturned the entire tender process.
Currently, Nuclearelectrica holds 51% of EnergoNuclear S.A., CEZ – 9.15%, GDF-SUEZ – 9.15%, ENEL – 9.15%, RWE Power – 9.15%, and ArcelorMittal and Iberdrola, each with 6.2%. The Romanian State via Nuclearelectrica, is expected to reduce its participation to 20% at some point. Units 3 and 4 should be functional in 2016.
